Ryan Tufts, Secretary-Treasurer for the Committee of Adjustment, calls the meeting to order at 5:08 p.m.

Theresa Nicodemo put her name forward for Chair and ran unopposed. 

Maria Ferraro moved for Theresa Nicodemo to be Chair and was seconded by Valentina Brunone. Theresa Nicodemo was voted in as the Chair.

Vince Marcotte put forth his name to be Acting Chair in Theresa Nicodemo's absence.

    That the minutes of the meeting of the Committee of Adjustment dated November 9, 2022 be adopted as presented.

Ryan Tufts, Planning Technician, gave a presentation on the Application.

Anthony Pipolo, Agent, spoke to the Application and had no objections with respect to Mr. Tufts report

Valentine Brunone asked about the lot frontage for the Minor Variance.

Mr. Tufts explained that approximate dimensions are included in the Notice and report, but the decision and certificate would have the exact request. 

Vince Marcotte asked what the depth of the property is.

Mr. Tufts advised the depth is 250'. 

Mr. Marcotte asked if Administration was comfortable not having the Planner present at the meeting.

Allen Burgess, Supervisor of Planning and Development, advised that he had been in discussions with the Applicant and Agent before the meeting and they are aware of the requirements of an agreement and servicing.

Gudrin Beggs, Director of Planning and Development, advised that a severance agreement would be required.

Mr. Marcotte asked if Front Road would be required to be re-paved when servicing.

Mr. Burgess advised that it would be one continuous pave done of the entire lane so there would not be patches.

Mrs. Brunone asked if it would be shown on the engineering drawings.

Mr. Burgess explained that it would be part of the engineering drawings and the severance agreement. Mr. Burgess also advised that the Applicant/Agent would be required to obtain a right-of-way permit from the Town's Public Works Department. 

Jackie Lassaline, Planner, joined and advised she had no concerns with the report but would be available for any questions.

    That whereas the Minor Variance, is consistent with the general intent and purpose of the Official Plan and the implementing Zoning By-law, as amended from time to time, and having heard all comments and concerns from the public, agencies, and Town Staff, be it, therefore, resolved that Application A-09-2022 File # 4154 be approved subject to the following conditions:

    1. That application B-14-2022 and B-15-2022 File #4151 and 4152 be approved and all conditions achieved;

    That whereas the Consent is consistent with the general intent and purpose of the Official Plan and the implementing Zoning By-law, as amended from time to time, and having heard all comments and concerns from the public, agencies, and Town Staff, be it, therefore, resolved that Application B-14-2022 and B-15-2022 File #4151 and 4152 be approved subject to the following:

    1. That one (1) paper copy and one (1) digital copy in .DWG format of a reference plan depicting the subject lands, which has been prepared by an Ontario Land Surveyor and which has been signed, numbered, dated and registered be submitted to the Secretary-Treasurer;

       

    2. That the lands be consolidated in the title;

       

    3. That the existing home be demolished;

       

    4. That the Applicant submits a lot grading and servicing plan prepared by a Professional Engineer for the subject lands to the satisfaction of the Town Engineer;

       

    5. That the Applicant applies for a Right-of-Way Permit with the municipality and the required fees are paid in full;

       

    6. That the Applicant enters into a Severance Agreement with the Town, pertaining to the subject lands, to be registered on title at the entire cost of the Applicant, including, but not limited to such matters as servicing, drainage, fees, easements, securities and other matters as they relate to the development of the lands;

       

    Carried.

Ryan Tufts, Planning Technician, gave a presentation on the Application.

The Applicant and their Agent were not present at the time the item was being heard. 

The Chair asked the Committee if they would be comfortable hearing the item in the absence of the Agent or Applicant. The Committee opted to hear the item.

Vince Marcotte asked how it could be a mistake. Did they not ask what the setbacks were before they started? Mr. Marcotte asked if there would be grading issues as a result of the reduced setbacks. 

Gudrin Beggs, Director of Planning and Development, advised that this was an unfortunate circumstance and that there would not be any grading issues with the construction of the pool house.

    That whereas the Minor Variance, is consistent with the general intent and purpose of the Official Plan and the implementing Zoning By-law, as amended from time to time, and having heard all comments and concerns from the public, agencies, and Town Staff, be it, therefore, resolved that Application A-10-2022 File # 4154 be approved subject to the following conditions:

    1. That the applicant obtain a Building Permit from the Town of LaSalle;

       

    2. That the above be fulfilled by January 25, 2025

     

    Carried.

The next meeting of the Committee of Adjustment will take place on Wednesday, February 22 at 5:00 p.m.

The meeting is adjourned at 5:37 p.m.
