Meeting to Consider the Engineer's Report under Section 78 of the Drainage Act, R.S.O. 1990

The purpose of the Meeting to Consider is for the Engineer to present their Report to Council for consideration. At the Meeting, Council will provide the opportunity for landowners to discuss the Report. In consideration of the Report and public comment, Council will decide whether or not to proceed with the project provisionally adopting the Report by By-law. Council can refer the Report back to the Engineer for modifications and discuss the potential need to debenture the cost of the project. There is no right to appeal assessments or other aspects of the Engineer’s Report at this meeting; these appeal rights are provided for later in the process to the Court of Revision.

St. Michaels Drain Engineer’s Report for Meeting to Consider

• Recommendation

  That the report of the Manager of Engineering, dated November 7, 2023 (PW-20-2023) regarding the St Michaels Drain Engineer’s Report be received;

  And that Council adopts the St Michaels Drain Engineer’s Report, dated July 26^th, 2023, authored by Rood Engineering Inc.;

  And that, By-law 8837, being a by-law for the repair and improvements of the St Michaels Drain be provisionally adopted.

  That the following By-law be given a first and second reading:

  8837 - A By-law to provide for the repair and improvements of the St. Michael's Drain in the Town of LaSalle, in the County of Essex.

Confirmatory By-law

• Recommendation

  That Confirmatory By-law 8838 be given first, second, and third reading and finally passed.
