Public Hearing for applications under sections 45 and 53 of the Planning Act.

The Minutes will reflect this accordingly.

The public is invited to comment by submitting written comments and or speaking to an application listed on the agenda. Members of the public who wish to speak to an application are encouraged to contact Committee of Adjustment Staff by email or phone to rtufts@lasalle.ca or by calling 519-969-7770 Ext.1252. When your request is received, confirmation and instructions will be provided for participating in the hearing.

  • Recommendation

    That the minutes of the meeting of the Committee of Adjustment dated November 17, 2021 be adopted as presented.

Application for a Minor Variance to allow a reduced garage setback from 7.5  metres to 6 metres.

  • Recommendation

    That whereas the Minor Variance, is consistent with the general intent and purpose of the Official Plan and the implementing Zoning By-law, as amended from time to time, and having heard all comments and concerns form the public, agencies, and Town Staff, be it therefore resolved that Application A-13-21 File # 4126 be approved subject to the following conditions: None

Application for Consent to create one lot addition to the property at 4099 St. Francis Crescent.


Application on Behalf of: Giuseppe Giglio and Suzana Buac


Location of Application: 4097 St. Francis Crescent  

  • Recommendation

    The subject lands are zoned a Residential Two zone (R2) according to Zoning By-Law No. 8600, as amended.

    The applicant wishes to sever a parcel of land with a frontage of 7.5 metres and an irregular depth having an area of approximately 146 m².

    The retained parcel of land will have a frontage of approximately 21 metres and a depth of approximately 39 metres, having an area of approximately 0.48 hectares.

    If the application is successful, the applicant wishes to create one lot addition to the property at 4099 St Francis Crescent.

  • Recommendation

    That whereas the Consent is consistent with the general intent and purpose of the Official Plan and the implementing Zoning By-law, as amended from time to time, and having heard all comments and concerns from the public, agencies, and Town Staff, be it therefore resolved that Application B-01-22 File #4130 be approved subject to the following:

    1. THAT one (1) paper copy and one (1) digital copy in .DWG format of a reference plan depicting the subject lands, which has been prepared by an Ontario Land Surveyor and which has been signed, numbered, dated and registered be submitted to the Secretary-Treasurer;

    2. THAT all of the above conditions be fulfilled on or before January 26th, 2022

Application for Consent to create one new building lot.


Application on Behalf of: Francois and Heather Gratton


Location of Application: 4772 Montgomery Drive

  • Recommendation

    That whereas the Consent is consistent with the general intent and purpose of the Official Plan and the implementing Zoning By-law, as amended from time to time, and having heard all comments and concerns from the public, agencies, and Town Staff, be it therefore resolved that Application B-15-21 File #4127 be approved subject to the following:

    1. THAT one (1) paper copy and one (1) digital copy in .DWG format of a reference plan depicting the subject lands, which has been prepared by an Ontario Land Surveyor and which has been signed, numbered, dated and registered be submitted to the Secretary-Treasurer;

    2. THAT the Applicant enter into a Severance Agreement with the Town, pertaining to the subject lands, to be registered on title at the entire cost of the Applicant, including, but not limited to such matters as servicing, drainage, fees and other matters as they relate to the development of the lands;

    3. THAT the Applicant prepare lot grading and servicing plans prepared by a Professional Engineer for the severed and retained lands to the satisfaction of the Town Engineer;

    4. THAT all of the above conditions be fulfilled on or before January 26th, 2023.

Application for Consent to create one new lot.

Location of Application: 165 and 171 Riverview Avenue

  • Recommendation

    That whereas the Consent is consistent with the general intent and purpose of the Official Plan and the implementing Zoning By-law, as amended from time to time, and having heard all comments and concerns from the public, agencies, and Town Staff, be it therefore resolved that Application B-16-21 File #4128 be approved subject to the following:

    1. THAT one (1) paper copy and one (1) digital copy in .DWG format of a reference plan depicting the subject lands, which has been prepared by an Ontario Land Surveyor and which has been signed, numbered, dated and registered be submitted to the Secretary-Treasurer;

    2. THAT the Applicant enter into a Severance Agreement with the Town, pertaining to the subject lands, to be registered on title at the entire cost of the Applicant, including, but not limited to such matters as servicing, drainage, fees and other matters as they relate to the development of the lands;

    3. THAT the Applicant prepare lot grading and servicing plans prepared by a Professional Engineer for the severed and retained lands to the satisfaction of the Town Engineer;

    4. That the Applicant provide a copy of the deed indicating the Owner has successfully obtained the 8’ portion of right of way;

    5. THAT all of the above conditions be fulfilled on or before January 26th, 2023.

    That whereas the Minor Variance, is consistent with the general intent and purpose of the Official Plan and the implementing Zoning By-law, as amended from time to time, and having heard all comments and concerns form the public, agencies, and Town Staff, be it therefore resolved that Application A-14-21 File # 4129 be approved subject to the following conditions:

    1. THAT one (1) paper copy and one (1) digital copy in .DWG format of a reference plan depicting the subject lands, which has been prepared by an Ontario Land Surveyor and which has been signed, numbered, dated and registered be submitted to the Secretary-Treasurer;

    2. THAT file B-16-21 be approved,

    3. THAT all of the above conditions be fulfilled on or before January 26th, 2023

  • Recommendation

    That whereas the Minor Variance, is consistent with the general intent and purpose of the Official Plan and the implementing Zoning By-law, as amended from time to time, and having heard all comments and concerns form the public, agencies, and Town Staff, be it therefore resolved that Application A-14-21 File # 4129 be approved subject to the following conditions:

    1. THAT one (1) paper copy and one (1) digital copy in .DWG format of a reference plan depicting the subject lands, which has been prepared by an Ontario Land Surveyor and which has been signed, numbered, dated and registered be submitted to the Secretary-Treasurer;

    2. THAT file B-16-21 be approved,

    3. THAT all of the above conditions be fulfilled on or before January 26th, 2023
